Question by cathy: Repossession?
2 months ago my car was repoed. I paid a repo fee and a storage fee of $ 450.00…To recieve my belongings. I was not allowed to look in the car to see if anything was left behind. Now they sent me a letter telling me the car was sold at Auction for $ 450.00
They want me to pay 1,681.45 + 480.00 additional storage fee + $ 250.00 For another repo fee. I know that the car has been for sale on there lot since they took it and that it was not sold at aution. If it was they would have gotten more for it. Please advise me on what to do.
they are charging me twick for repossession fee and storage fee!
Question by becaleca: Legal question about obtaining car title.?
We bought a car from a repo man (our brother-in-law) June 26th of 2007. We have the Bill of Sale and posession of the car. He lives in WA and we live in OR. On the Bill of Sale it states that we would receive the title in the mail within 2 weeks. It has been almost a year and he has not sent it to us. We have not been able to drive the car for about 6 months because we cannot register it in OR without the title. He keeps making up stories about why he hasn’t sent it to us (like the finance company that he repoed the car for wants more money for the vehicle). I called the finance company and they told me that he owes them nothing and all he has to do is go to the WA DMV and fill out a Lien Holder’s Claim. He will then have the title to send to us! He will not return our calls. He has lied to us several times about the title. We have called the DMV and they told us he is the only one that can get the title. Any ideas about how to get the freakin’ title of the car? Any legal options?

Answer by joker_32605 Tell him in writing by Certified Mail, Return Receipt Requested that this must be resolved within 30 days or you will be forced to sue him for specific performance of his contract with you. Tell him if you have to sue him your attorney said he will have to pay all legal costs including court fees and attorney fees. Then, do it.
The car is aging and becoming worth less and you are not enjoying the use of it. If you are forced to sue him, you can add this to your lawsuit.
Does his wife, who I assume is related to one of you, have any influence on him. Perhaps you could talk to her and explain that you would rather not sue but you have to do something to resolve this.
Send the letter off tomorrow. It will probably get him to take action.

Question by : Can you sell a car while it has a loan?
I have a 2006 hyundai sonata with a $ 13,000 loan currently owed on it. I cannot afford the payment any more and I have really good credit so I dont want to take a chance of missing a payment and getting it repo’d. So if I were to sell it in a private sale, could I keep the loan and sell the car for the sale price, I.E. $ 9000. And apply the $ 9000 to the loan. But, Can I keep the loan in my name and sell the car? I live in Akron, Ohio. The loan is thru Wells Fargo.

Answer by Scott W you wont get 9000.00 and if you did sell it for that price the bank wont give you the title until the other 4000.00 is paid and the loan is paid in full.i booked this car out and it retails for 7850.00 im a dealer.
