Question by fitgalmel1: Can I stopped my car from being repossessed?
I was 2 car payments behind, payed one yesterday, so am 1 payment behind. Today a man came to repossess my car. He had the wrong VIN number, I guess and did not take it. If I make my behind payment tomorrow, can I stop it from being repossessed?

If you work out a deal with the lien holder you can probably stop it.

This is just a hypothetical situation:

Your behind on your car payments, so your car gets repossessed by the dealerships repossession team. Well, your friend just happened to have some of his belongings that he had left in your car, obviously not knowing it is going to be repossessed.

Now, legally, who does the friend go after? Will the dealership/repossession team allow the friend to take his belongings out of the car?

If not, who does the friend go after, legally? The person who was buying the car, or the dealership/repossession team who repossessed the car?

Legally (in most states I know of), the person that does the repossession must keep all contents of the car for the owner to retrieve. The only property they are allowed to forward to the lien holder is the vehicle itself, so anything in the car *should* be available at the towing/repossession office where the car was taken.

If it is not, the owner of the stolen property (that’s what it is if it’s not returned) can file suit in civil court; they can call police and try to press criminal charges, but it’s far easier to be compensated through the civil process.
